Techoni is a internet scam fraud company

I called Techoni and asked if they had a I-Mate JasJam in stock on Oct
10, 2006.  They said they did and their wesite said they had it in
stock with 2 - 4 days shipping.  I gave them my credit card.  They
charged my credit card immediately on Oct 10, 2006 and did not ship my
I-Mate JasJam as of Oct 7, 2006.  I called them serveral times asking
for a shipping tracking number. Sometimes sales says the I-Mate JasJam
is back ordered and sometimes they say it's being packed.  I asked for
a refund and they said it could take 14 days!!  This totally
unacceptable.  Don't buy anything from Techoni.

I strongly suggest issuing a credit card charge back with your bank.

I've never heard of this mob, so I'm neither recommending them, nor
condemning them, but how could they have sent it on Oct 7 if you didn't
pay for it until Oct 10?

I called Techoni and asked if they had a I-Mate JasJam in stock on Oct
7, 2006.  They said they did and their wesite said they had it in

2-4 days tends to mean 2-4 business days, i.e. Monday - Friday.  So if you
ordered it on a Saturday you'd have to wait until Monday for them to process
the order in a meaningful way, then allow 2-4 business days, i.e. until
Friday the 13th, for shipping.

Aside from the merits or otherwise of your case, did you try exercising your
consumer rights
(eg. Dept of Fair Trading can be very effective) before slagging off
against a registered,
legitimate, bona fide business in here?

T**** may exercise their rights too, given the nature of your posting.

It appears you have exhausted verbal reproach with the company. I suggest
time to:

1) write a letter or email to the appropriate management in the company
setting out your concerns and what action you would like to happen.
2) Set a deadline for response, flagging that you intend to pursue the
matter with Dept of Fair Trading (NSW) if the matter is not resolved.
3) After the deadline, if no satisfaction, submit a report to Dept of Fair
Trading. This can be filed via their website.

Thanks for your advice.  It would not be defamation because the
statement was made to protect public interest and is of public benefit.
In addition, it is a "fair comment".  I honestly hold the opinion that
I was and still being defrauded.  They have my money and I don't have
the product.

Techoni is in violation of the Australian Trade Practices Act of 1974
Sect 58.   You can not take payment for goods or services knowing that
you can not deliver the goods or service within the period specified.
Techoni specified 2-4 days.  I know did not have the item in stock.  In
fact, they are in violation of another unfair practice called "Bait
Advertising".

Sheesh!  I got overcharged by my local supermarket but that doesn't
automatically earn them the title of  scam/fraud company.

That sect actually says

    (b)  there are reasonable grounds, of which the corporation is aware
   or ought reasonably to be aware, for believing that the corporation will
   not be able to supply the goods or services within the period specified
   by the corporation or, if no period is specified, within a reasonable time.

That is quite different to your restatement.

I called these people on Friday to purchase the same product, and they
seemed patient and friendly. They put one aside for me for me to pickup
in the afternoon.

I didn't have time to get into the city on Friday, but intend to do so
on Monday.

It seems from the way the poster has posted that he jumps to conclusions
very easily.  It sound to me more like a problem happened somewhere, and
he deals with it irrationally. I am not sure how credible the poster is
- his dates are all wrong - his expected ship date was before the date
he gave his credit card details - if he actually did.

My colleague purchased an O2 PDA from them earlier in the year, so I
doubt they are a "internet scam fraud company"

Why not just go in there or call them up? You say you are in Sydney.

I agree. I purchased an "in stock" item from them 3 years ago, yet it took
two weeks to reach me. In the mean time, they told me the price they'd
advertised was wrong and wanted to charge my credit card further. And
despite living near their office, I wasn't allowed to pick up or pay for the
item in person.

So I said "never again". I'm surprised they're still around.
