if i were to buy a phone on ebay that was stated as 'unlocked', i could then
bring this to a cingular store and have it activated on my current
account... right?
thanks.

No need to bring it in. All you have to do is take you current sim and pop
it in you new phone. Unless you want to add a new phone to your account,
then you just need a new sim card.

Then just call Cingular and give them the electronic serial number and they
will set it up.

If that's the case you need to be sure that the 5165 was used on the
cingular network. If it was used on ATTWS for example it may be SOC
locked to ATTWS.

Assuming of course that you're using it in a cingular area that
supports the frequency/frequencies of the phone you got on ebay.
Don't forget that cingular is operating GSM on two different
frequencies depending on where in the US you happen to be. cingular
is operating at 1900 Mhz on the west coast, in the Carolinas and
eastern Tennessee. Elsewhere they're mostly using GSM at 850 Mhz. If
you purchase a handset that can do either you should have no problem
in the US. If you purchase a 1900 Mhz handset and your area only has
cingular at 850 Mhz it won't do too well for you.
