Dealer mistake--can I cancel my contract?

The Cingular dealer I ordered my service from hooked me with a $29.99
plan plus a 2nd line ("Family Plan") for $9.99.  My 1st bill charged
me 19.99 for the 2nd line and a call to customer service got that
reduced.  My 2nd bill was again 19.99 and this time I took the problem
back to my dealer.  I'm being told there never was a plan at 29.99 +
9.99 and I must now pay the extra 10 bucks per month.  Or cancel and
be hammered with hundreds of $$ in termination fees and 'dealer
chargeback'.  These are the choices customer service relayed to me via
the dealer who apparently screwed up the order.
I feel if they won't hold up their end of the contract why should I
have to abide by any part of it either?
Do I need to go through my dealer who doesn't want to admit his
mistake or the customer service drone to cancel my plan without being
charged these fees?

Do you have a hard copy of a contract you signed showing the $29.99 + $9.99?

Sure do--but CIngular CS has said it's up to the dealer to decide if
they will take back the phones & cancel my contract.  Sounds like BS
to me.

Call the customer care center at 800-331-0500 and ask to speak with a
supervisor.  Give them the details and explain who you spoke with.
Also, try to document everything and keep a log.  'They' do..

I've had nothing but horrible experiences with my Cingular from day 1.
The v60ti then they changed it to a v60g and that wasn't correct
either for my area until they pushed me up to a T720 on GSM-- they
even had enough balls to ask me to pay for the upgrade!   I demanded
to cancel and NOT have to pay for a break lease fee.  The CS rep
disagreed until I demanded to get this taken care of properly.  Since
a phone doesn't work, or there is a discrepency on your bill, you
should not be at fault with their foul-ups.  Good luck.

I'll sympathize with your being misinformed by the dealer the first
time, but its true that there are no family plans available on calling
plans under 39.99.    I had to correct the guy at the dealer on this
issue as well when I signed up for my cingular service, as he was saying
the same thing.   Fortunately I had read their plan details on the
website before going shopping.  
You might be able to swing something with a CS rep on this one if you
have some documentation to prove your situation.  What does it say on
the contracts you got (the pink sheets)?

It clearly sez $29.99 + $9.99
Another store had a newspaper ad in the window advertising "Choose
your plan, get up to 5 additional lines for $9.99 each".  The table
underneath showed plans starting at $29.99.   No fine print, no
asterisks (I looked carefully because I was aware what the Cingular
website said--but others have commented here on the frequent errors on
the website).  So I didn't doubt the guy's offer.

I had the same thing happen to me in 2000.  A kid at a mall kiosk sold my
wife and I this:  2 phones, shared 250 anytime minutes, shared 500 weekend
minutes, unlimited mobile-to-mobile (not between the 2 phones, unlimited
calling to ANY other Cingular phone), all for $27.99.  The contract he wrote
it up on didn't spell this out exactly, he said the new paperwork for the
plan wasn't in yet, so I made him write what he said I was getting on the
contract and sign it.  Of course when the first bill comes, an extra $19.99
is on the bill for the second phone, and we don't have unlimited
mobile-to-mobile.

To make a very long story short:  Skip CS, they couldn't do anything on
their end, but a very helpful CS person told me to go to a Cingular
corporate location and ask to speak with the manager over the affiliates.  I
did so and they hooked me up with a regional manager.  He started going into
an explanation of how people are confused when they look at several plans,
etc., and he was certain the kid didn't lie to me just to get a commission.
I told him I had it in writing and it was signed by the kid at the mall.  He
asked me to fax it to him.  I did. He called back, apologized for the
confusion and said the plan would be honored.  My bill was messed up for the
first couple of months.  I called CS, asked them to look at the comments on
my account (put on by the regional manager), they immediately credited my
account.  It's been smooth sailing since.  95% of our calls are to/from
other Cingular users, I'll leave this plan when they pry it from my cold,
dead fingers.
