cancelling account

I've been with Cingular for over a year (2 years contract) and I have to
say that it's been a pretty good service for the most part. Recenty
though I stopped receiving signal at home. Cingular has been trying to
fix it but with no success - can I cancel my contract without
cancellation fee since they stopped delivering service I signed up for?
The fact that I was getting signal at home for the reason why I swithced
to Cingular from T-Mobile.

Any thoughts are appreciated.

I suggest that you ask them to let you out of your contract but if they
refuse (which I expect) then I suggest you go to FCC.GOV and file a
formal complaint and demand they either correct the situation or let you
out of your contact and refund you for the time the service was not
operational. I understand that they are legally required to answer those
complaints.  Be sure to include that it did work at one time and that is
the reason you went to them.

They are messing with the network and its management and I suspect that
part of that is to get the former AT&T customers to sign up for a new
account with Cingular.

its not going to work, they don't guarantee service in areas wont change
over time.. its in the contract.

That's simply a disclaimer of service not being available in all areas.
Significant degradation of service is a different issue.  As a matter of law,
the carrier can't hold you to a contract when the carrier has stopped
performing.  (Caveat:  I am not an attorney, and this is not legal advice,
simply my lay understanding.  You should consult your own attorney.)

I just had the sector pointed at my house fail for several days.  It
turns out the radios were working but not communicating back to
anything so I either had the usual great signal or EmergencyOnly.  In
either case I could not make or receive calls.  If I drove up to the
site it did work (from one of the other sectors apparently).

So I tried to go through the normal channels to report the problem
which has always been an exercise in futility with every carrier and
true in this case as well.  The normal response is "there are no
reported problems in your area."  Well, someone has to be the first
one to report the problem and that's me.

I developed great high level contacts at Omnipoint/VS/T-Mobile.  In
fact they sent people to my office to check and fix a problem and even
came to my rural house to see if they could tweak the sectors
(couldn't) but I eventually had to switch because they just stopped
building out before covering this area like Cingular does now.

Anyway, I contacted the person that gets all the new sites installed
around here and she actually had a hard time getting an RF engineer to
respond to her.  It took days.  They said they would have eventually
found it when the traffic logs showed no activity.

When you only have one sector/site it would be nice if there were some
way to at least get someone to take a look at a problem.  I'm not
asking for a personal visit but at least address the problem.
