Cellularking.com - bad news.

This is not slander. Simply a warning based on facts, and a request
for advice.

About three weeks ago I paid Cellularking.com $109.90 for an item on
their web site. It said "in stock" and "-19 available for immediate
shipping". (Even today it says "in stock" and "-39 available for
immediate shipping".)

I found out the hard way that the "-" is not a dash but probably a
minus sign. The item is out of stock and has been discontinued by the
manufacturer. Yet they continue to advertise it.

I paid via PayPal. They do not accept credit cards.

After about 2 weeks of not hearing from them or receiving anything I
called. The guy, apparently the proprietor, said he was going to have
to refund me because it was a discontinued item. He said he would do
it that day or the next. Nothing happened. I called back. Was told
"he" would be in in an hour. I called back. They said "he" would be in
in an hour. I e-mailed him. Nothing. Two days later I called again. He
said he would refund me the same day. Nothing happened.

I think I'm being blown off. Is this not theft? Am I being
unreasonable here? Is there something I am missing? (Besides the
lesson not to pay with PayPal.)

I hate to get a lawyer, but if I do it's gonna cost 'em more than
$109.90. Anyone have any suggestions short of getting a lawyer?

I know they read this newsgroup and hopefully they will take me more
seriously now.

Hey, sorry to hear about your troubles :(
It's not worth getting a lawyer imho, just consider it as a lesson learned.
ala` never pay with paypall.

If a 'website' can't afford a few hundred $'s a month to pay for a merchant
account and a SSL server, you shouldn't be doing business with them. But
then again, that's just my opinion.

He should have used a credit card via Paypal then at least he would have
been afforded some protection via the credit card.

Problem solved, no thanks to cellularking.com .  Here's the story...

The theives never responded to my request and began to ignore my phone
calls (caller ID?) and e-mails. I did some research and found that
e-bay and google groups were littered with serious complaints about
them. Folks were not getting any customer support. All sales were
final, even if they didn't get the merchandise. Items shipped were not
new as advertised. Etc.

These complaints are not all against cellurking.com. Some are with
companies owned or operated by the same bandit, who will remain unamed
here. They include probeep.com, celluarprincess.com (now defunct?),
telson.com (trashy foreign movies). I was also able to determine that
the owner goes by several names.

At any rate, all of this was of no value. I initiated a formal dispute
through the PayPal system. After a couple of weeks the PayPal system
determine that the seller was at fault and they took the money out of
his account and refunded me. I don't think the bandit would ever have
given me the money back.

Lesson learned.

By the way, if any prosecutors in New York ever decide to develope a
case against these people please call me. I will gladly drive up there
at my own expense to testify. They really need to be put out of
business.
