Hi,
I'm having a persistent problem with an annoying company, phoning me
on my mobile, trying to persuade me to upgrade my Orange mobile phone.
They have called me at least five times, including when I was abroad,
costing me money.
I've just had a call from them five minutes ago, and the company was
"Comminuque" or something. I was sarcastic to the guy, told him to
piss of, and hung up.
The number they ring from is 0800 0887700.
My number is registered from with the telephone preference register.
How do I make an official complain and hopefully have them prosecuted?
tpsonline.org.uk says "Please note we are happy to offer a complaint
handling service as a value added service, however we are not the body
responsible for enforcement and we are unable to take action against
companies complained about."
Is there a better place to make a complain, maybe Ofcom?
Thanks.

I thought ICSTIS only dealt with premium rate numbers.

They do, just looked at the website.

Keep ringing their 0800 number from any landline. It won't cost you a penny,
but every call you make they are charged for the usage.

if possible record your conversation and stay polite :-P
Ask him for a fax number or a postal address, and fax or send via
recorded delivery a letter stating that they are
1 not to ring you again
2 not permitted to pass your number onto any third parties
3 going to be charged £1000 per telephone call from them from a
certain date - say 7 days after the date of the letter. This gives
them time to affect their database. If they contact you again after
that point by any means (call, SMS etc) then they agree to the charge
stated.
If he won't give you the fax number, ring the 0800 number and say you
have some contract details to confirm and have been asked to fax it it
- and get the number that way.
If they then contact you again you issue a letter claiming your £1000.
if they fail to pay (which they will!) you take it through the small
claims court - should cost about £80 - whcih you would get back on top
of your £1000 when you win the case.

[Thanks for all the replied in this thread, won't respond to each one

Yes :) Usually I'm a polite person, but after missing one or two calls
fromthem I would have thought that they would give up, let alone five :)

That's a great idea. I will certainly do that if they ring again, thanks
I phoned up the 0800 number, and they are actually called "Communicated",
claiming to be one of the "fasting growing leading independent specialists"
or some other similar nonsense.
Oh well, in the mean time I will amuse myself by ringing this number as
other people have suggested. How unfortunate it would be if I were to
accidentally set my modem to repeatedly dial this number one evening and
then not notice this until the morning. I dread to think how much money it
would cost them....

Just be aware that anytime you dial an 0800 number that number gets a
record of you calling as they are paying for the transport of the
call. If they find that you are calling them repeatedly or are
purposely calling them with the express purpose of inflating their
telecom costs it may come back to bite you in the butt as that can be
considered harassment. It's wrong for them to bug you but it's also
wrong for you to repeatedly call them to inflate their costs.

Not necessarily. We have two 0800 numbers, from different suppliers.
One gives calling numbers, and the other only gives the first few
digits of the number.

And how, exactly, could they prove that?

If they ring you again tell them you'd love a free upgrade, then tell them
your contract is on Orange OVP Virgin tarrif. ;-)
No-one has bothered me since.

good fun to call their freephone number and put them on hold. make a
new call and set up a conference call with the first number you
called. Do this 4 times so you are in effect calling their freephone
number 5 times at once. Once they are all connected, press 1 on each
call so you are being transferred to the rep. Eventually you will get
5 reps talking to each other.
hehehehehe

Yes, Ofcom is where you complain. Try and get as much info from the sales
droid as possible, name of company, physical address, main switchboard
number.
Be creative, get the salesdroid drooling, say you need the info for credit
checks, I even got one company to give me the name of their bank!!!!!
Calling a number that is registered with the tps breaches the licence
agreement that the selling company has with their telephony provider and
they could lose their connection.
Also your telephone number is considered personal data by the information
commissioner so you can complain there too. But if you go down this route,
prepare yourself for a fight, they are the laziest bunch of incompetent
jobsworths in the whole of officialdom.
