Spam from 82868 (and more spam!)

I received the following message below today.  First bit of SMS spam
I've really received and just want to check something.

"FreeMsg: Hi ur on r Mobshack dbase 2 receive Free mobile promos, to
receive more, txt or reply YES to 82868. If u wish 2 be removed snd STOP
to 82868. Thank u."

Not wanting to have to phone/contact T-Mobile (I'm on a self-serve
tariff with 50ppm calls to CS up to £5 per call) - I just send STOP to
82868 and hope thats the end of it (around 12:50 this afternoon).

Almost straight away I get a reply: "Your account has now been
deactivated, to reactivate you account simply text 'CHAT' to 82868".

Fine - done what I hoped.  Well, sort of.  I then receive another 5 of
these messages over the following 1.5 hours.  So far I've had 6 replies
- the last one at 2:23pm.  Initially they came through just a few
minutes apart (12:53, 12:54, 12:56) now they've spaced out a bit more -
13:04, 13:26, 14:23.

I've checked my T-Mobile online account and can't see any bills for the
texts - yet.

Has anyone else had this before?  I've found their information out from
Icstis:

Yep received my first bit of spam on my home account today first time in
3yrs, very annoyed.

ICTIS have a help sheet:

You can report the company to ICTIS on   0800 500 212  (or on their
website).
They'll investigate and take appropriate action which can lead to service
suspension and / or ban and / or fine

If you havent dont already, you might want to register your mobile number
with TPS:

It's a valid point; but go have a gander at exactly how many of those
companies actually paid the fines, makes for laughable reading. We British
are way too polite...

I agree that the fine enforcement is a joke - But at least the service gets
pulled.

The annoying thing is that it is not clear whether sending STOP to that
number will cost anything.

I had the same thing last night - 5 responses to a STOP message,  so
also logged it with Orange and their "secure messaging".

Got a reply saying the SMS wasn't from Orange but a 3rd Party (ie WIN).
You can call 0845 1309911 to get an interactive menu, enter your mobile
and it tells you which shortcodes you're "registered" with and options
to stop all further messages. Took about 2 minutes - whether or not I'll
be charged remains to be seen.

That only applies to companies registered in the UK.

Want to bet? A couple of weeks ago, I set up some software for a
client. It was from www.datalinkuk.com also knows as www.holbi.co.uk.

Address in Berkshire. However, to talk to the developers, you have to
ring a phone number in eastern europe. Even the UK phone number sounds
like a very long voip connection at a low data rate.

In fairness, their software does what we wanted. But their claims of
being in Berkshire seem somewhat exaggerated.

Tell Tmobile you will sue them to recover the costs as you did not request
those texts and they should be stopping reverse charges.  The reason some
companies don't is because they get a huge cut out of it.  It's fraudulent
activity being facilitated by mobile companies.

Interesting ... my wife received the same unsolicited message, but we
ignored it (did think about sending a stop message but thought better)
- since then we have had no further messages.

Whereas the stop message may work I always treat it like spam - reply
and you're confirming a working mobile number :(

I had the same message yesterday but forwarded it to Orange's SPAM
service. I'm glad I did now!

Whether anything is ever done, I have no idea but it's nice to think
there's a team of dedicated spam hunting Orange employees just waiting
for some dodgy phone companies to destroy.

Or maybe it just gets sent to SMS equivalent of dev/null. Who knows?

David,

I have seen your post and thought i could help. The message you
recieved was a free message to see if you wished to be removed from the
database. You could reply at no cost either with a stop or a yes. If
you replied yes you would be able to recieve offers from mobshack. You
would only be charged should you wish to take advantage of the offers.
with regards to receiving several of these messages i cannot understand
how this happened and am looking into this right away. I will post
again. should you have any query relating to this and wish to speak
directly to a mobshack representative please feel you can call anytime

something along the lines of: -

Unsolicited Spam

Dear Sir/Madam

Telephone Number: xxxxxxxxxxx

I refer to an unsolicited SMS message received today at 10.45am. I
states:

FreeMsg: Hi ur on r Mobshack dbase 2 receive Free mobile promos, to
receive more, txt or reply YES to 82868. If u wish 2 be removed sn
STOP
to 82868. Thank u."

I direct you to the following EC directive, Directive 2002/58/EC of th
European Parliament and the Council of 12th July 2002 which states:

"Safeguards should be provided for subscribers against intrusion o
their privacy by unsolicited communications for direct marketin
purposes in particular by means of automated calling machine, telefaxe
and email, including SMS messages. These forms of unsolicited commercia
communications may on the one hand be relatively cheap and easy to sen
and on the other may impose a burden and/or cost on the recipient
Moreover, in some cases their volume may also cause difficulties fo
electronic communications networks and terminal equipment. For suc
forms of unsolicited communications for direct marketing, it i
justified to require that prior explicit consent of the recipients i
obtained before such communications are addressed to them."

I have never expressed my explicit permission for WIN (Wireles
Information Network) Ltd or any of it’s agents to contact me i
any form. I consider this to be unsolicited and therefore in breach o
the EU directive which was enacted in 2003.

I require you to cease and desist immediately from contacting me fo
direct marketing purposes without my express permission. I also requir
you to disclose under the Data Protection Act the person or company tha
WIN (Wireless Information Network) Ltd received my phone number from.
also require a written apology from WIN (Wireless Information Network
Ltd and £25.00 to recompense me for time spent on this matter and cost
incurred by this unsolicited spam. I refer you to Roberts v. Medi
Logistics Ltd.

I have seen this post and thought i could help. The message you
recieved was a free message for you to respond with a yes or a stop.
If you replied yes you would start to recieve offers from mobshack. If
you replied stop you would be instantly removed from the database.
It would only cost you the price of a text message to reply and at no
point would there be a premium charge. With regards to several of the
messages landing i am looking into this right away. If you would like
